To protect your rights and confirm the contractual relationship, all users who apply for the Consummate Arts Website Service (hereinafter referred to as "the Service") should read the following terms of service carefully:
I. Terms of services for members
1. Upon completion of the registration as the member of Consummate Arts or starting to use the Service will imply that you have read, understood and agreed to accept all the contents under the Terms of Service.
2. The company may modify or change the contents of this agreement in response to environmental needs. The revised terms of service will be posted on the website. Members will not be notified individually. You are advised to pay attention to such modifications or changes at all time. If you continue to use the Service after any modification or change, you are deemed to have read, understood and agreed to accept such modifications or changes. If you have any concerns, please contact the Customer Service.
3. If you are a minor under the age of 20, your parent (or guardian) should read, understand and agree to all the contents and modifications of this agreement before you can register as a member and use or continue to use the Service. When you use or continue to use the Service, it is presumed that your parent (or guardian) has read, understood and agreed to accept all of the contents of this agreement and its subsequent changes.
II. Obligations of members during registration
In order to use the Service, members must agree to the following related regulations:
1. According to the instructions during service registration, members are to provide correct and up-to-date information. Do not repeat registration or do not use third party information to register.
2. Update the correct and latest information promptly to get the best service.
3. If the information provided by the member is untrue, wrong, outdated, repeated or is using third party’s information and the company has reasonable grounds to believe that the information provided by the member is false, incorrect, outdated, incomplete, repeated or using of the third party's information, the company may suspend the member's right to use the Service without any notice.
III. Privacy Policy
1. Regarding the personal data provided during registration or when using the Service, the Company will use and protect it in accordance with the Privacy Statement Policy.
2. When the customer uses the service, the data recorded during the course of the use are subject to the information recorded in the service database. If there is any dispute, the electronic data recorded in the service database will be used as the basis for judgment unless the customer is able to produce other information which is proven to be true.
IV. Member Account, Password & Security
Upon completing the registration of the Service, the member will receive account and password information. In order to protect rights of members, the account and password information must be properly kept. Members should be fully responsible for all their actions and agree to the following terms:
1. When the account password is found to be stolen by others or there is any breach in security, the Company should be notified immediately.
2. Confirm the account connection is ended upon completing the transaction.
3. The account information and membership rights are reserved to the use of the member only and may not be transferred, loaned or shared.
4. When the information is input in accordance to the prescribed login method and information, it will be presumed to be used by the member himself regardless the information is entered by the member himself/herself or not.
5. The company will only be responsible for the damages of proven situations such as if member information is embezzled, illegally used or when the company is not able to identify whether it is caused by member's own act. Otherwise, the company shall bear no responsibility on the damages.
6. If the company discovers improper or illegal use of the service by members or violations on the Terms of Service, the company may terminate or suspend the use of the member service either partially or completely in order to maintain the security of the transaction.
V. Protection of Intellectual Property Rights
The software or programs used by the company and all contents on the website, including but not limited to works, pictures, files, information, website structure, website layout, web design or other materials, are owned by the company or other right holders according to law, including but not limited to the trademark rights, patents, copyrights, trade secrets and know-how. No one may use, modify, reproduce, publicly broadcast, modify, distribute, release, publish, restore, decompile or dissemble it. If a member wants to quote or reprint the above mentioned software, program or website content, he/she must obtain prior written consent from the company or other right holders in accordance with the law.
VI. Member's legal obligations and commitments
1. Members shall promise not to use the Service for any illegal purpose or in any illegal manner, and commit to comply with the relevant laws and regulations of the Republic of China and all international practices in the use of the Internet. If you are a user outside the Republic of China, you have to agree to abide by the laws of your own country or region.
2. The company is not responsible for the content published by members in the company and reserves the right to delete any content that infringe the copyright or patented content of the other party’s works. The company has the right to directly delete the content that is deemed harmful, offensive, infringing or violating the terms. If it is determined that the member's action does not meet the requirements of the relevant terms of service, the company has the right to discontinue the provision of the service, including but not limited:
• Do not post or transmit any words or pictures that are defamatory, insulting, threatening, offensive, indecent, obscene, false and in violation of public order or custom traditions.
• Do not infringe or damage the reputation, privacy, business secrets, trademarks, copyrights, patents, intellectual property rights and other rights of the company or others.
• Do not interrupt the network services and transmit or distribute computer viruses.
• Do not engage in commercial activities that are not approved or authorized by the company.
• Do not post, disseminate, and send spam or chain letters, illegal or multi-level marketing messages and advertisements which has not been authorized by the company. Or store any material that infringes upon the intellectual property rights of others or violates the law.
• Comply with all the agreements, regulations, procedures, and practices of using network services.
• Other acts, besides the above terms, that do not conform to the purpose of use provided by the Service or deem inappropriate by the Company after justification.
VII. Service disruption, suspension and changes in service content
The Company will maintain the Service in accordance with generally appropriate technology and methods. However, under the following circumstances, the Company may suspend or discontinue the provision of the Service
1. When performing necessary maintenance and construction on the electronic communication equipment.
2. When the company is unable to provide services in the event of sudden electronic communication equipment failure, force majeure due to natural disasters or other reasons that cannot be accounted for by the company.
VIII. Relevant Laws and Regulations
All materials of the company's website may not be copied, transferred, rented or sold without the prior written consent or authorization of the company. Members have the obligation to abide by relevant laws and regulations. If any member violates the law and causes loss to the company, compensation will be sought according to the law.
IX. Applicable Law and Jurisdiction Court
The interpretation and application of this agreement, as well as the disputes related to this agreement, shall be handled in accordance with the laws of the Republic of China. The Taichung District Court of Taiwan shall be the court of first instance.
